Moniruzzaman's appointment in ACC valid: HC
1/6/2006

The High Court (HC) approved the job of M Muniruzzaman Mian as Commissioner of the Anti-Corruption Commission (ACC), discharging a writ petition that challenged his appointment, report agencies.
A HC division bench comprising Justice MA Matin and Justice M Rezaul Haque delivered the verdict Thursday after hearing both sides.
Over a year after his appointment, Saidur Rahman Khan, a lawyer, filed a writ petition December 15, based on a newspaper report, challenging the validity of the appointment.
On January 3, Maniruzzaman filed the petition seeking discharge of the rule earlier.
Counsel for the petitioner Barrister Rafiqul Huq submitted before the court that the selection committee on ACC had selected the name of Maniruzzaman from its second list and sent it to the President. That was why, the rule over his appointment cannot be maintained.
The ACC was constituted with Justice Sultan Hossain Khan as its Chairman and Maniruddin Ahmed and Maniruzzaman as members on November 21, 2004.
In the writ petition, it was submitted that as per the provisions of Anti-Corruption Commission Act, 2004, three persons, who have at least 20 years of experience in law, education, administration, judiciary or disciplined forces will be selected as commissioners of the ACC, but Maniruzzaman had no such experience.
