Kibria murder case
SC stays HC order rejecting petition for reinvestigation
2/8/2006

Within three hours of charge framing by the Speedy Trial Tribunal of Sylhet against the accused of Kibria killing case, the Supreme Court (SC) Tuesday stayed for three weeks all of the case proceedings.
Chamber Judge of the Appellate Division Justice Amirul Kabir Chowdhury passed the order of stay upon an application for leave to appeal to overturn a High Court verdict that had discharged the plea for further investigation into the sensational Kibria murder case.
The court also asked Dr Kamal Hossain to file leave-to-appeal petition within the stay time, report agencies.
On November 21 last year, the High Court discharged a writ petition that sought further investigation into the murder of Awami League leader and former Finance Minister Shah AMS Kibria, with observations that it has no jurisdiction to order further inquiry into the case pending with the trial court.
On March 20, senior ASP of the CID Munshi Atiqur Rahman submitted the charge-sheet to the court against 10 suspects, which was disapproved by complainant Abdul Majid, organising secretary of Habiganj Awami League, saying that the charge-sheet was "full of flaws".
Meanwhile, charge-sheets against eight accused in this connection were submitted to the Sylhet division Speedy Trial Tribunal Tuesday.
The charge-sheeted accused AKM Abdul Qaiyum, Jainal Abedin Jalal, Md Jamir Ali, Jainal Abedin Mumin alias Mumin Ali, Md Tajul Islam, Md Shahed Ali alias Jundu Mia, Md Selim Ahmed and Md Ayet Ali were produced before the court of District Sessions Judge Biplob Goswami.
Two other accused, Md Muhibur Rahman and Md Kajal Mia, have been absconding.
